IMPORTANT NOTICES

If you receive your check in the mail and the due date falls on a weekend or holiday, the payment should arrive on the next business day

We encourage you to make use of Electronic Funds Transfer (EFT). You don't have to wait for a check to clear. With recent cutbacks in U.S. mail service EFT is the way to go.

If you've sold some of your structured settlement payments to a settlement purchaser

If you have old some of your structured settlement payments to a settlement purchaser, t is possible that the unsold part of your future structured settlement payments is being "serviced" NOT by the annuity issuing life insurance company, but by either (1) the settlement purchaser, (2) a servicing subsidiary of the settlement purchaser or (3) another company, bank of or other financial institution that provides servicing on such transactions.  Some of the common servicing companies are Happy State Bank d/b/a Goldstar, Security Title and Sutton Park Capital.

Structured settlement servicing is necessary primarily because some structured annuity issuing life insurance companies choose not to split annuity payments so the annuitant must transfer ALL of their structured settlement payment rights (i.e. even the unsold portion) to a factoring company or servicing entity. When structured settlement payments are subject to a servicing agreement following a sale of structured settlement payments for "cash now", you must contact the entity that is servicing your annuity payments, not the annuity issuer. If you have sold multiple times to different companies you may have more than one servicing company. It's a pain in the bum for sure, but it's a consequence of selling.

Are you an investor in structured settlement payment rights, having bought someone else's structured settlement payments?

Investors who have acquired structured settlement payment rights in the structured settlement secondary, or tertiary market, should be mindful to determine (at the time of purchase), whether they have acquired serviced structured settlement payments and be guided accordingly.  If you have invested in structured settlement payment rights that are being serviced, you may need to direct all of your questions to the payment servicing company not  the annuity issuer.  For investors it's not as simple as it would be if you had bought a regular annuity and would be able to interface with the annuity issuing life insurance company directly.  Here you didn't buy an annuity (no matter what the salesperon told you. You bought payment rights) We recommend that you carefully document the details and contacts along with your instructions should you become incapacitated and your final instructions.

If you have a structured settlement that was issued by Allstate Life Insurance Company (now Everlake Life Insurance Company) or Allstate Life Insurance Company of New York  (now Wilton Reassurance Life Insurance Company of New York) and you have a structured settlement that includes a period certain followed by life time payments

(e.g. 30 years certain and life), this is a reminder that Allstate had a peculiar way of issuing contracts. While other companies issue a single contract, Allstate actually issued two policies, an A policy and a B policy with the same contract number. One of these contracts was for guaranteed lump sums or certain payments and the other for lifetime payments. Occasionally there has not been a seamless transition. In 2015 during the course of assisting an Allstate annuitant who found us on the Internet, we learned that Allstate had outsourced its customer service to a call center in the Philippines. Unfortunately, in our opinion, because the Allstate call center employees were not servicing the accounts prior to 2013 and thus not familiar with the history of Allstate structured settlements, it led to the Allstate call center employees disseminating inaccurate information. Fortunately we were able to correct for the insured quickly, by making multiple calls to the Allstate home office until we found someone who knew the history.  Because the Allstate New York and non-New York entities were divested as of 2021, you may run into the same issue.  Make sure you keep a copy of your Allstate contract(s) and settlement paperwork in a safe, secure, fireproof and waterproof place.

Independent Life & Accident Company

Indpendent Life & Accident was a life insurance company that issued debit life insurance primarily in the Southeastern United States, that was acquired by American General in 1997.  Independent Life & Accident Company is often confused with Independent Life Insurance Company because of the similar name.  Independent Life & Accident did not issue structured settlement annuities.  Please note that Independent Life Insurance Company only issues structured settlement annuities and was not around when your grandmother, grandfather, your parents, or perhaps you, bought the debit life insurance . When you call American General for life insurance questions at 800-888-2452, please bear in mind that the rep who picks up the phone might not have been born (or potty trained) when the policy was sold  (and may not know the history), so be patient! You may need to escalate to a supervisor. Don't give up.
