STRUCTURED SETTLEMENT CUSTOMER SERVICE TIPS
If you receive your check in the mail and the due date falls on a weekend or holiday, the payment should arrive on the next business day
We encourage you to make use of Electronic Funds Transfer (EFT). You don't have to wait for a check to clear. With cutbacks in U.S. mail service, EFT is the way to go.
Have you previously sold some structured settlement payments to a settlement purchaser ?
If you have sold some of your structured settlement payments to a settlement purchaser, it is possible that the unsold part of your future structured settlement payments is being "serviced". Servicing is NOT performed in such cases by the annuity issuing life insurance company, but by either (1) the settlement purchaser, (2) a servicing subsidiary of the settlement purchaser or (3) another company, bank of or other financial institution that provides servicing on such transactions. Some of the common servicing companies are (or have been) Happy State Bank d/b/a Goldstar, Security Title and SuttonPark Capital*.
Servicing is very common in the banking industry with mortgages. If you took out or refinanced a mortgage with Bank A or Finance Company A, you may receive a notice shortly after closing saying that the loan "being serviced" by Bank B.
The necessity for structured settlement servicing arises mainly because certain life insurance companies, which issue structured annuities, opt not to divide annuity payments. Consequently, the annuitant is compelled to transfer all their structured settlement payment rights, including the unsold portion, to a factoring company or servicing entity. Our sources indicate that some issuers of structured settlement annuities will not split payments for specific types of payment streams, such as cost of living adjustments (COLA). If your structured settlement payments are under a servicing agreement after a sale for "cash now," you should contact the servicing entity, not the annuity issuer. Selling your payments multiple times to various companies may result in dealing with more than one servicing company. Although it can be troublesome, it is an inherent result of the process of selling structured settlement payment rights.
*ALERT RE SUTTONPARK 7/2024 (UPDATED 12/9/2024 and April 27, 2025) If you've sold a portion of your structured settlement payment rights through a factoring transaction, and your payments are/were being managed by a Florida-based company named SuttonPark (a subsidiary of 777 Partners), you might face significant delays in receiving payments while a backup servicer is established. John Darer of 4structures has received numerous calls in his voluntary role as the Structured Settlement Watchdog from both payees and investors in structured settlement receivables, who have been experiencing delays from SuttonPark since around June 1, 2024, with the situation worsening in November 2024.
To bring attention to the affected individuals and address the lack of information from SuttonPark, John Darer has shared victim impact narratives on his watchdog blog and has reached out to assist those reliant on these payments, respecting the dignity of the victims and human decency. If you find yourself affected and are not using direct deposit, it is advisable to switch to direct deposit. As of December 9, 2024, SuttonPark had not provided a specific date for when payments will resume for recipients who are paid by check.
Subsequently certain payment streams serviced by SuttonPark became serviced by DRB Capital and others by Axos Bank.
In February 2025, SuttonPark made an announcement to Court Ordered Assignees (if you sold structured settlement payments in the past, the Court Ordered Assignee would be named in the Court Order approving the transfer of structured settlement payments). Court Ordered Assignees were notified that the SuttonPark lock box facilities were being closed and that the Court Ordered Assignees should seek an alternate payment servicer. At least one Court Ordered assignee offered options to buy out the remaining payments (at a discount) as well as an option to change payment servicers at a modest lesser cost.
The SuttonPark case exposed the perils of making partial sales of structured settlement payment rights with a servicing agreement, or investing in structured settlement receivables with a servicing agreement. John Darer, President of 4structures.com, LLC spent more than 26 pro bono hours between mid November 2024 through February 2025 listening, providing empathy, providing victim impact stories so that voices could be heard
Are you an investor in structured settlement receivables, having bought someone else's structured settlement payment rights?
Investors who have acquired structured settlement receivables (structured settlement payment rights) in the structured settlement secondary, or tertiary market), should be mindful to determine (at the time of purchase), whether they have acquired serviced structured settlement payments and be guided accordingly. If you have invested in structured settlement receivables that are being serviced, you may need to direct all of your questions to the payment servicing company and not the annuity issuer. It can be confusing for some people.
For investors it's not as simple as it would be if you had bought a regular annuity and would be able to interface with the annuity issuing life insurance company directly. Here you didn't buy an annuity (no matter what the salesperson told you). You bought structured settlement receivables. One of the documents investors sign is a Receivables Purchase Agreement. We recommend that you carefully document the details and contacts along with your instructions should you become incapacitated and your final instructions.
Also please see alert re SuttonPark above.
If you have a structured settlement issued by Allstate Life Insurance Company (now Everlake Life Insurance Company), or Allstate Life Insurance Company of New York (now Wilton Reassurance Life Insurance Company of New York), and you have a structured settlement that includes a period certain followed by life time payments, please read the following:
For those who have Certain and Life structured settlement payments (e.g. 30 years certain and life). This is a reminder that Allstate had a peculiar way of issuing contracts. While other companies issue a single contract, Allstate actually issued two policies, an A policy and a B policy with the same contract number. One of these contracts was for guaranteed lump sums or certain payments and the other for lifetime payments. Occasionally there has not been a seamless transition. In 2015 during the course of assisting an Allstate annuitant who found us on the Internet, we learned that Allstate had outsourced its customer service to a call center in the Philippines. Unfortunately, in our opinion, because the Allstate call center employees were not servicing the accounts prior to 2013 and thus not familiar with the history of Allstate structured settlements, it led to the Allstate call center employees disseminating inaccurate information. Fortunately we were able to correct for the insured quickly, by making multiple calls to the Allstate home office until we found someone who knew the history. Because the Allstate New York and non-New York entities were divested as of 2021, you may run into the same issue. Make sure you keep a copy of your Allstate contract(s) and settlement paperwork in a safe, secure, fireproof and waterproof place.
Found an Old Policy from Independent Life & Accident Company?
Independent Life & Accident was a life insurance company that issued debit life insurance (primarily in the Southeastern United States) that was acquired by American General in 1997. Independent Life & Accident Company is often confused with Independent Life Insurance Company because of the similar name. We've fielded hundreds of calls from relatives who find an old policy after a relative dies.
What is/was Debit Life Insurance?
The death benefits for these policies were minimal, typically $1,000 or less, and the payments (premiums) each week, usually a few dollars, were paid by cash. Debit Life Insurance was also known as "Industrial Life insurance" or "Street Life Insurance". The agent who sold such policies was sometimes referred to as a debit agent or colloquially as the "tally man". The book carried by the debit agent as they walked door-to-door contained a list of their customers' names and addresses, the customer's policy death benefit amount, their weekly premium amount, and how much money had been collected. Independent Life & Accident Company did not issue structured settlement annuities!
- Please note that Independent Life Insurance Company only issues structured settlement annuities and was not around when your grandmother, grandfather, your parents, or perhaps you, bought the debit life insurance.
- When you call American General for life insurance questions at 800-888-2452, please bear in mind that the rep who picks up the phone might not have been born (or born, but not potty trained) when the Independent LIfe & Accident acquistion took place or when the policy was sold (and therefore may not know the history), so be patient! You may need to escalate to a supervisor.
- Don't give up.
